HIV & ICE: Know Your Rights
A pocket guide for people living with HIV in the United States. Print, fold, carry. Share it with anyone who might need it.
If ICE Comes to Your Door
- Do not open the door. You are not required to.
- Ask them to slide the warrant under the door or hold it up to a window.
- A valid warrant must be signed by a judge and must list your name and your address. A warrant signed by an ICE officer (Form I-200 or I-205) is not enough to enter your home.
- You have the right to remain silent. Do not answer questions. Do not sign anything without a lawyer.
If ICE Stops You in Public
- Stay calm. Do not run. Do not resist physically.
- Ask: "Am I free to go?" If yes, walk away calmly.
- If they say no, you are being detained. Invoke your right to remain silent and your right to a lawyer.
- Do not show false documents. It is safer to show no documents than false ones.
Red-Card Script — Say or Show This
"I do not wish to speak with you, answer your questions, or sign or hand you any documents based on my Fifth Amendment rights under the United States Constitution. I do not give you permission to enter my home. I do not give you permission to search any of my belongings. I want to speak to a lawyer."
If detained — HIV-Specific Ask
Say clearly: "I have a medical condition. I take medication every day and cannot miss doses. Please contact the ICE Health Service Corps and my clinic."

ICE's 2025 National Detention Standards require facilities to continue your HIV medication without interruption. Your attorney and clinic can cite this policy.

- The name of your HIV regimen and your daily dose.

- Whether they have your permission to speak with your clinic or attorney on your behalf.

Si ICE Llega a Su Puerta
- No abra la puerta. No está obligado(a) a abrirla.
- Pida que pasen la orden por debajo de la puerta o la muestren por la ventana.
- Una orden válida debe estar firmada por un juez y debe indicar su nombre y su dirección. Una orden firmada por un oficial de ICE (Formulario I-200 o I-205) no es suficiente.
